We at RSG Group USA, Inc. d/b/a Gold’s Gym (together with subsidiaries of RSG Group USA, Inc., “Gold’s Gym,” “us,” “we,” “our,” “the Company”) respect your privacy and are committed to protecting your personal information. This Privacy Notice explains how and why Gold’s Gym collects, uses, and discloses your personal information safely and securely, and how you may exercise your rights with respect to your information.

When this Privacy Notice Applies

This Privacy Notice applies to our collection of information when you interact with any Gold’s Gym services (collectively, “Services”), which include Gold’s Gym owned and operated websites, interactive tools and mobile apps (collectively, “Sites”) that link to this Privacy Notice; Gold’s Gym branded company-owned fitness clubs (“Gold’s Gym Clubs”); the products and services we offer; and in-person, over-the-phone, and electronic communications and services provided by Gold’s Gym either with customer support personnel or a software agent using artificial intelligence (also known as an “AI assistant”).

Residents of certain U.S. states, including California, may have additional rights under applicable state privacy laws. Our State Privacy Notice supplements this Privacy Notice and serves as our notice at collection under applicable law. Please review it for important information about your rights and our data practices.

When this Privacy Notice Does not Apply

Gold’s Gym Franchise LLC also franchises rights to independent third parties (“Franchisees”) to own and operate gyms under the Gold’s Gym brand pursuant to franchise agreements (a “Franchise”). As explained in more detail here, this Privacy Notice does not apply to collection, use, and disclosure of your information by Franchisees, except as described in this notice. Please contact your gym if you have any questions about their data collection and use, or to exercise any rights where applicable.

By using our Sites and Services, you agree to the collection and use of information in accordance with this Privacy Notice.

INFORMATION WE COLLECT

For purposes of this Privacy Notice, “personal information” means any information that is linked or reasonably linkable to an identified or identifiable individual.

There are several ways we may obtain personal information about you, including through (1) information you provide to us, such as when you visit our Sites, register as a member or for a free pass, communicate with us, including via our AI assistant, use the Gold’s Gym Clubs, or purchase merchandise; (2) information we automatically collect; (3) information we receive from third parties; and (4) combining information from different sources. This includes data that identifies you personally whether directly or indirectly.

1.1 Information You Provide

We collect personal information that you provide to us in connection with your use of the Sites and Services. This information includes:

• Account Information: When you register for a Gold’s Gym membership or free pass, visit Gold’s Gym Clubs, use our Services, contact us directly, or interact with us on social media, you may provide us with certain Account Information, such as your:
  • Contact information (e.g., name, email, physical address, phone)
  • Date of birth and gender
  • Username and Password
  • Social media handles
  • Personal Preferences and Interests, (e.g., favorite programs or classes)
  • Other personal information you voluntarily disclose.
• Financial Information: If you decide to purchase a membership or our merchandise, we may collect payment and identity verification information. If you use a credit card, we and our third-party payment processor may collect financial information such as credit card number and expiration date. For more information on how your Financial Information is used and shared in these instances, please see below (under “Payment Processors”).
• Communications: We collect certain information you may provide or share with us when you communicate with us. You may communicate with us in a number of ways, including (i) via a telephone call with a live person or AI assistant, (ii) via a text chat with a live person or AI assistant, (iii) via email, or (iv) via a webform on our website completed by you. In such cases, information we collect includes (i) questions or concerns you submit via our customer service functions or in consultations with our personnel or an AI assistant, (ii) information provided during service calls, text chats, or online chat recordings, and (iii) metadata and logs.
• Marketing Communications: We collect information or feedback you may provide in connection with customer testimonials, surveys, promotions, contests, sweepstakes, marketing events, trade shows, webinars, conferences, customer research, or similar communications.
• Social Media: We may monitor and collect information from your interactions with our social media accounts, which are operated by third parties, posted on our accounts, or linked to us on third-party operated social networks or other web offerings (such as Twitter/X, LinkedIn, Facebook, Instagram, Pinterest, Reddit, TikTok, or Google). Our Sites may include social media features, such as the Meta Like button and widgets, the Share button, or interactive mini programs that run on our Sites. Your interactions with these features are governed by the privacy notice of the social platform providing it.
• Information and Content You Post: Our Services may include community forums or other similar online spaces where you may be able to connect with other users.  When you post or share comments or other content when using our Services, we may collect (and share) information such as your name, username, email, comments, likes, interests, status, and pictures. You may also choose to post audio or visual content such as photos, videos, or recordings, which we collect through the interactive features of our Services. You are responsible for all content you post.
• Other Information You Provide, Including Health-Related Information: You may also provide us with other information, in person and offline, such as when you visit or use the Gold’s Gym Clubs. For example, you may fill out membership forms or personal training questionnaires and provide us information, including health or medical information, or connect your wearable devices, such as fitness trackers, smartwatches, and health monitors, during such interactions and others. Where additional notices regarding data collection are required, we will provide those at that time.

1.2 Information We Automatically Collect

When you visit a Gold’s Gym Club or our corporate offices, we use closed-circuit television and other technologies for fraud prevention, security, and asset protection.

Website Usage Information

Gold’s Gym also collects information about your browser or device, and how you use the Sites and Services, when you interact with our Sites (“Usage Information”). Usage Information we collect may be combined with other information we collect about you to improve the Services, and for marketing, analytics, and site functionality. Usage Information includes:

• Device information. This includes any device you use to access our Sites and Services, including your Internet Protocol (IP) address, device ID, hardware model, operating system version, mobile network information, and other information that identifies your computer or device
• User interaction information. This includes the type of browser you use, loading and access times, pages you viewed and features you accessed, the page you visited before navigating to our Sites, whether you have started or completed use of an offering or purchase, keystrokes, mouse movements, form field entries, recordings of chat sessions or your use of and inputs to other AI-supported tools, and other use and overall engagement with our Sites and Services. We also may keep track of how you interact with links on the Services, such as in emails, third-party services, and client applications.
• Marketing Information. If you receive an email from us, information may be collected about your interactions with the message (e.g., whether you opened, forwarded, or clicked through to our Site).
• Geolocation Data. If you enable background location services on your mobile device, we may collect your precise geolocation even when the Gold’s Gym application is not open. For example, if you choose to share your precise geolocation with us, the mobile app may automatically launch the bar code screen when it detects that you are near a Gold’s Gym location. You may turn off location services at any time by changing your mobile device settings. Independent of your device permissions, the IP address we collect through your use of our Sites, as described above, may itself indicate non-precise information about your location.

Cookies and Similar Technologies  

We use cookies and similar technologies to automatically or passively collect Usage Information to administer our Sites (and Services), understand how you use our Sites and analyze trends, and gather information about our users, as described above. These technologies may include small data files stored on your hard drive or in device memory or electronic images or strings of HTML, JavaScript, or URL code that can be added within emails, online ads, and websites, and help us to improve our Sites and Services and your experience, enhance security, evaluate which areas and features of our Services are popular, and measure total usage. They can also enable the delivery of relevant and personalized advertisements to you across the Internet. Examples of these technologies include cookies, SDKs (software development kits), web beacons/pixels, local shared objects, and UTM codes/tags. We enable third parties we engage to deploy such technologies on our Sites to help us analyze how our users are using the Sites (and Services) and to deliver advertising.

You may elect to have your browser not accept cookies via the “Do Not Sell Or Share My Personal Information” in the homepage footer. For further information, please see “Your Rights” below.

Our Use of Google Analytics and Advertising Technologies

Our Sites use technology provided by Google to facilitate advertising and reporting. We implement Google Analytics cookies to collect personal information about you when you visit our Site for purposes of remarketing, impression reporting, and demographic and interest reporting. This information includes browsing and Usage Information and can be combined with other data related to you collected through Google’s advertising cookie or other third-party technology. You can opt out of the use of this technology through the Google Analytics opt-out browser add on, Google Ad Settings, and/or Ad Settings for mobile apps.

1.3 Information We Collect from Others

In addition to the information you provide or that we automatically collect, we may receive personal information from other sources. Our third-party sources may include:

• Our Business Partners, Franchisees and Affiliates. This includes companies that co-sponsor our promotions.
• Our Marketing/Advertising and Analytics Partners. This includes online advertising networks and analytics providers that assist us in engaging in targeted advertising.
• Social Media Platforms. If you link a social media account through our Services, we may automatically receive certain information about you based on your registration and privacy settings on those third-party services. This may include, but may not be limited to, name, username, demographic information, updated address or contact information, location, interests, social media and online activity.

1.4 Combination of Information

We may combine personal information that we receive from various sources. For example, we may combine personal information that we collect from you offline with personal information we collect from you through our Services. Similarly, we may combine personal information that we receive from third parties with personal information we already have about you. We use, disclose, and protect combined personal information as described in this Privacy Notice.  

HOW WE USE YOUR INFORMATION

We collect information for a number of purposes, as described below.

To provide you with Services and administer your membership account, including to

• Sign you up for and manage your membership account or guest pass
• Provide the Sites and Services, including access to and use of certain features of Gold’s Gym Clubs not operated by our Franchisees, and for payment purposes
• Administer your participation in a contest, sweepstakes, or other promotion
• Redirect you to a Franchisee website based on your location

To communicate with you about your account or our relationship, including in connection with your customer service requests, notifying you about changes to this Privacy Notice, our terms or your account, and sending you other transactional or relationship communications.

To improve our Services and analyze trends and customer interests on our Sites or relating to our Services, including to

• Improve our Sites and Services, including by identifying ways to make our Services better
• Recommend products and services that may interest you
• Develop new ways to purchase and browse our Services
• Personalize the content on our Sites so you have a consistent and tailored experience
• Identify your interests based on your interactions with us and information we have received from third parties or publicly available sources

For security and asset protection purposes, including to detect, investigate, and prevent fraud, threats and unlawful activities in our Gold’s Gym Clubs and corporate offices, on our Sites, and in your account, or to verify your identity, as may be required or permitted by law.

For our marketing, including to

• Send you communications about promotions or offers via regular mail, email, phone, or other electronic channels, including ads on social media platforms
• Send you newsletters and other information you have requested

You can update certain marketing communications preferences by following the instructions in the Your Communications and Opt-Out Options section below.

To provide you with ads, including targeted advertising, and other communications that align with your interests, we may use information collected across different online services and collected from the various devices you use. For example, if you view a product on our Sites, we may arrange for you to see ads for that product or similar products on our Site or third-party websites and applications.

For social media engagement, to interact with you across various social media platforms, including for

• Public Interaction: responding to your comments, mentions, and direct messages.
• Content Delivery: displaying targeted advertisements or “boosted” posts that we believe will be relevant to your interests based on your platform preferences.
• Social Analytics: analyzing engagement data (likes, shares, and clicks) to better understand our audience and improve our content strategy.

Note: When you interact with us on these platforms, your information is also subject to the privacy policies and terms of service of the respective social media provider. We encourage you to review your privacy settings on those platforms to control how much of your profile information is visible to us and others.

To protect the safety and security of Gold’s Gym, our Services, our members, and others, and comply with applicable laws.

For other uses. We may also use information for purposes disclosed to you at the point of collection, as authorized by you, or as otherwise permitted or required by law.

HOW AND WHY WE DISCLOSE YOUR INFORMATION

We may disclose the information we collect from and about you within our organization and with certain third parties as described below.

• Business Affiliates. We may share your data with our affiliates, subsidiaries and parent companies (“Affiliates”), for the purpose of any necessary collaboration.
• On-Site Business Partners. For your convenience, Gold’s Gym Clubs may offer products or services provided by third-party operators, including, but not limited to, fitness equipment and tools and fitness trainers. Third-party operators operate independently from us, and the privacy practices of the relevant third parties, including details on the information they may collect about you, are subject to the privacy policies of those third parties, which we strongly encourage you to review, as their practices may differ from ours.
• Franchisees. Many Gold’s Gym locations are owned and operated by independent Franchisees.  When you sign up for a free trial at a Franchisee Gold’s Gym on our website, you are providing the information within the form to both us and the independent Franchise owner of the gym for which the free pass is requested. We may also share information with our Franchisees in other circumstances, such as when you complete a survey, provide feedback or make an inquiry. • Payment Processors. When you make a payment for the Services, we process your payments via a third-party payment processor. In these instances, the third-party payment processor may collect certain Financial Information from you to process a payment on behalf of Gold’s Gym, including your name, email address, address and other billing information in which case the use and storage of your Financial Information is governed by the third-party payment processor’s terms, conditions and privacy policies.  
• Vendors. Gold’s Gym engages certain vendors that may process personal information submitted to Gold’s Gym to perform certain business-related functions and to increase the functionality of our Services, as well as for marketing and advertising.
• Service Providers. This includes vendors, consultants, affiliates, and other service providers who assist us in providing our Services and use and disclose information to perform services on our behalf. These companies are directed to not retain, share, store, or use personal information for any secondary purpose. 
• Advertising and Marketing Partners. We may disclose your personal information to third parties for targeted advertising, including social media platforms, third-party advertising networks, and other parties that assist us in serving and optimizing our advertisements. We may also disclose certain information to companies, including our affiliated entities and third parties, which provide services that help us market our products or otherwise support the promotion of our business.
• Social Media. We may share your information with third-party social media sites to market our services, including to offer you interest-based ads as described above. We may also provide functionality on our Services that allows you to automatically post information to third-party social media Services.  If you choose to take advantage of this functionality, people with access to your profile on the third-party Services will be able to see your posts.  In addition, if you choose to link your profile on our Services with an account on a third-party social media Service, we may share the information in your profile with that third-party Service.
• Other Disclosures. We also may disclose information about you to support these other purposes:
• Law Enforcement or Regulatory Requests: We may disclose your information to law enforcement, government agencies, and others if we believe disclosure is in accordance with any applicable law, regulation, or legal process, or as otherwise required by any applicable law, rule or regulation.
• Fraud and Abuse Prevention: We may also disclose your information if we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property, and safety of Gold’s Gym or others.
• Relevant Third Parties as Part of a Corporate Transaction: In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your personal information to certain third parties, such as the acquiring entity and its advisers.
• Mobile phone number: If you have consented for us to call or text you, we do not sell or share your consent to receive calls or texts with other parties to use for their own telemarketing purposes. However, we may disclose your mobile phone number to vendors that assist us with providing text message alerts for product information, account status, promotions, or other marketing activities.
• Other Third Parties. We may disclose your personal information to other parties at your direction or with your consent, where required by law, or as we believe necessary or appropriate either to: (i) comply with applicable law; (ii) protect our operations and those of any of our affiliates; (iii) investigate and prevent against fraud; (iv) protect our rights, privacy, safety, or property and/or those of others; or (v) allow us to pursue available remedies or limit damages that we may sustain.

THIRD-PARTY LINKS

Our Services may contain links to third party websites, which are clearly identified and will direct you from Gold’s Gym’s site to a third-party site. Gold’s Gym does not direct or oversee the information policies, procedures or other practices for companies other than Gold’s Gym. If accessing a third-party site via a link, you will be directed to that third-party’s website and governed by their privacy notice and policies. We encourage you to review their privacy notices to learn more about what information is collected, how it is used, and how it is stored.

FRANCHISE PRIVACY POLICIES

Our Services may contain links to our Franchise micro-sites for the join online process, which is clearly identified and will direct you from Gold’s Gym’s website to the local independent Franchisee for your selected location. When you access a Franchisee site via a link, you will be directed to that Franchisee’s website and their collection of your personal information will be governed by that Franchisee’s privacy policy. We encourage you to review the Franchisee’s privacy notices to learn more about what information is collected, how it is used, shared, and stored.

In addition, when you visit a Gold’s Gym location owned by an independently operated Franchisee, or otherwise provide your information to a Franchisee, you provide your information directly to the Franchisee and are subject to their privacy practices and policies. The Franchisee determines how your information may be collected, used, and shared, including for the purpose of providing you with requested services and products, and marketing. Additionally, the Franchisee may share some of your information with Gold’s Gym.

If you are a member of a Franchisee gym, all privacy-related inquiries and requests should be directed to the local Gold’s Gym Franchise gym directly.

RETENTION POLICY

We retain your personal information as necessary to provide our Sites and Services or our business and commercial purposes for collecting your Personal Data. When establishing a retention period for specific categories of information, we consider several factors, including our purposes for processing information, whether we are legally required to retain information, and the sensitivity of the Personal Data.

In some cases, we retain Personal Data for longer, including if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, provide our Services, or is otherwise permitted or required by applicable law, rule or regulation. We may also retain information in a de-identified and/or aggregated form.

DE-IDENTIFIED AND AGGREGATED DATA

We may use information that has been de-identified or aggregated for various business purposes. In such cases, we commit to maintaining this data in a de-identified state (except solely to test, research, or validate the effectiveness of our de-identification methods), ensuring it cannot reasonably be linked to any individual, and we require recipients of such data to uphold these same standards.

HOW WE PROTECT YOUR INFORMATION

We have implemented reasonable physical, administrative, and technical safeguards to maintain the security, confidentiality, and integrity of your information. However, as no transmission of information over the internet is absolutely secure, we cannot guarantee the safety of your information.

CHILDREN’S PRIVACY

Our Sites are not directed at anyone under the age of thirteen (13); and we do not knowingly collect personally identifiable information from anyone under the age of thirteen (13), except in limited instances where a parent or guardian provides information about their child for Gold’s kid’s club childcare services, such as their child’s name, gender, and date of birth. If we become aware of a child under the age of 13 providing personal information directly to us, we will delete such data.

YOUR RIGHTS

The rights in this section apply to all users of our Services. However, some users may be entitled to additional rights under their state’s laws. As explained in our supplemental State Privacy Notice, in certain jurisdictions, you have certain rights, including the right to request access and receive information about personal information we maintain about you, even if you are not a member, to update and correct inaccuracies in your personal information, or to have the information deleted. INTERNATIONAL TRANSFERS

Gold’s Gym and it, or its service providers, may process, transfer, and store information about our users on servers located in different jurisdictions, including in the United States. In some of these locations, data protection laws may be less stringent than in your jurisdiction. To ensure that your personal information is adequately protected and as required by applicable law, we may transfer your personal information subject to suitable safeguards being in place.

YOUR STATE PRIVACY RIGHTS

CHANGES TO THIS PRIVACY NOTICE

We reserve the right to update or modify this Privacy Notice at any time without prior notice by posting a revised version of the policy on the Sites and Services. If we make material changes to this Policy, we will notify you by temporarily noting “UPDATED” next to the Privacy Notice link in the footer of our Sites or directly communicating with you via email or your account. Your use of the Sites or Services following revision to this Privacy Notice constitutes your agreement that all information collected from or about you after the revised policy is posted will be subject to the terms and conditions of the revised policy. The date listed above indicates the most recent change or update to this Privacy Notice.
