Getaway Sweepstakes

1. ELIGIBILITY: NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. GOLD'S "GETAWAY" SWEEPSTAKES (the "Sweepstakes") is open to new and current Gold's Gym members who are legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older. Gold's Gym International, Inc. ("Sponsor"), JUMP ("Administrator"), Travelocity, ("Promotional Partner"), and each of their respective parents, affiliates, subsidiaries, advertising and promotional agencies, participating retail locations and each of their respective officers, directors, employees and agents (collectively, with Sponsor, Promotional Partner and the Administrator, the "Sweepstakes Entities"), members of the immediate family of such individuals (including spouses, parents, siblings, children and their respective spouses) and persons living in the same household with such individuals are ineligible. Sweepstakes begins August 1, 2009 and ends on September 30, 2009.
2. TO Enter: 1. All current Gold's Gym members who have provided an email address as part of their membership/member account information will be automatically entered. No other action is required. 2. Join Gold's Gym between August 1 and September 30, 2009 and provide a valid email address as part of the member account information and be automatically entered. You may join in person or online at www.goldsgym.com. No other action is required. 3. Current Gold's Gym members who have not provided an email address as part of their member account information can complete the sweepstakes Registration Strip and place it in the Registration Box available at the front desk of Participating Gold's Gym's between August 1 and September 30, 2009. All entries must be placed in the Registration Box prior to the sweepstakes end date. Sponsor, Promotional Partners and all other Sweepstakes Entities are not responsible for illegible entries and or illegible entry information, lost, late, incomplete entries or entries that are not received prior to the end date. Entries not containing the required information and entries in excess of the stated limit by the same person will be disqualified. Any attempted form of entry other than described herein is void. Should any portion of the Sweepstakes be, in Sponsor's sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right to modify, suspend or terminate the Sweepstakes, in its sole discretion, and select winners from among all eligible non‑suspect entries received prior to the event giving rise to such cancellation or termination. Sponsor may prohibit a Participant from participating in the Sweepstakes or winning a prize, if in its sole discretion, it determines that said Participant is attempting to undermine legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Participants or representatives of Sweepstakes Entities. Any attempt by a Participant to deliberately undermine the legitimate operation of the game is a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent permitted by law.  Entries become the property of Sponsor and will not be returned.
3.  WINNER SELECTION: One (1) Grand Prize Winner, One (1) First Prize Winner and One (1) Second Prize Winner will be selected in a random drawing conducted by Administrator on or about October 16, 2009 from among all eligible entries received by Administrator, an independent judging organization, whose decisions are final on all matters relating to the Sweepstakes. Winners will be notified by phone, email or express mail on or about October 23, 2009. As a condition of winning, Grand Prize and First Prize Winners will be required to sign and return via overnight mail, within 14 days of notification, an Affidavit of Eligibility and Release from Liability ("Release") and a statement affirming the winner's grant of all rights for the Sponsor and Promotional Partners (where such condition is legal) to use winner's name, likenesses, information, and entry in all media for promotional purposes without additional permission or compensation. Second Prize winner will be required to verify mailing address within 14 days of notification. Failure to respond or return any documents within the time specified or failure to respond to notification attempts or return of any prize or prize notification as undeliverable will result in disqualification and selection of an alternate winner.
4. Prizes AND ODDS OF WINNING: One (1) Grand Prize: 5-Day/4-Night trip for two (2) to their choice of a Gold Gym location anywhere in the Continental US and $500 Visa Gift Card. Trip includes round trip coach class air transportation for two (2) people from a major U.S. airport nearest to winner's residence (to be determined by Sweepstake Entities in their sole discretion), double occupancy hotel accommodations (standard class except where specifically noted) (to be determined by Sweepstake Entities in their sole discretion), ground transportation to/from airport to hotel.  Air travel may include stopovers and connections. (ERV: $3500). One (1) First Prize: Nintendo Wii, and the Gold's Gym Cardio Kickboxing Game. (ERV: $399) One (1) Second Prizes: $100 Gold's Gear Certificate (ERV: $100). Total ERV of all Prizes $3999. Odds of winning depend on total number of eligible entries received. Grand Prize package does not include taxes, insurance, telephone charges, room service mini-bar and laundry services, personal expenses, gratuities, incidental charges, or any other items not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the winners. Travel dates and availability will be at the sole discretion of the Sweepstakes Entities. Blackout dates may apply. Trip must be taken by October 1, 2010.  No extension or change of trip dates by Winner will be permitted, if Winner is unable to travel at specified time prize will be forfeited in its entirety and awarded to an alternate winner, provided sufficient time remains to verify alternate winner and ticket prize, otherwise grand prize may be substituted with a prize of similar value at the sole discretion of the Sweepstakes Entities. Actual value of trip prize depends on the city of departure, time of travel, any airfare fluctuations and on current market conditions at time of prize fulfillment, and any difference between the stated ERV and the actual value if any, will not be awarded. Travel arrangements will be made through the travel coordinator designated by Sponsor. If the Grand Prize Winner lives within 100 miles of prize destination city the air transportation portion of the prize will not be awarded and ground transportation will be substituted and no additional compensation will be provided. Grand Prize Winner and his/her guest must travel together at the same time on the same itinerary. Once trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at Sponsor's sole discretion. Grand Prize Winner must confirm available travel dates and flight times selected by the Sponsor at least four (4) weeks prior to travel dates. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items once they are in Grand Prize Winner's possession, or in the possession of Grand Prize Winner's guest.  Sweepstakes Entities shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. If any portion of the Grand Prize is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, the remaining components of the Grand Prize will be awarded and Sponsor's obligation to the winner will be fulfilled, and no other additional compensation will be provided. The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release and/or prize travel documents. Sweepstakes Entities shall not be liable for any loss or damage to baggage. Grand Prize Winner and guest(s) are solely responsible for obtaining all necessary and required travel documents (valid US identification and or passport, etc.). Prize components cannot be used in conjunction with any other promotion or offer, and no portion may be separated except at Sponsor's sole discretion. Grand Prize Winner's travel companion (or parent/legal guardian if a traveling companion is a minor) must sign and return a Release of Liability/Publicity Release (where legal) prior to the issuance of travel documents. No transfer, substitution or cash equivalent for any prizes will be permitted, except at the sole discretion of the Sweepstakes Entities. Limit one (1) prize per person per household.
5. GENERAL: Sweepstakes is governed by the laws of the State of Texas, with venue and jurisdiction in Dallas County, Texas and all claims must be resolved in the courts located in Dallas County, Texas. By entering, Participants/winner agree: (1) to release the Sponsor, Promotional Partners, all other Sweepstakes Entities and their agents from all liability, loss or damage arising out of their participation in the Sweepstakes or any Sweepstakes‑related activity and with respect to their acceptance and use/misuse of the prizes; (2) to be bound by the Official Rules; (3) that the decision of the Sponsor is final and binding on all matters relating to the Sweepstakes; and (4) to the use of their names, personal information and likenesses for advertising and promotional purposes solely in connection with this promotion, in all media worldwide (including online) without additional compensation, except in Tennessee and where otherwise prohibited by law. All applicable federal, state and local laws and regulations apply. Winner is responsible for all federal, state and local taxes. Grand Prize Winner will be issued an IRS 1099 tax form for the actual value of their prize. An entry constitutes a grant of permission to the Sponsor or its agents to include winners' names on the www.goldsgym.com web site and in connection with a Winner's List without further notice and without additional compensation.  Participant's personal information submitted in connection with the Sweepstakes will be collected and used by Sponsor and its authorized agents to administer the Sweepstakes and to award prizes.  Participant's personal information may also be used to send Participant additional information about Sponsor and Promotional Partners, their respective affiliates and franchisees, and each of their respective products and programs via electronic and ordinary mail except, where prohibited by law. Sponsor and all other Sweepstakes Entities do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.
6.
