Cancellation Procedures

Because we receive so many calls with questions pertaining to canceling and because so many members misplace their paperwork, for your convenience we have posted an exact copy of the procedures that each member signed and agreed to follow.
 

DO NOT SIGN YOUR CONTRACT UNTIL READING

 

I have been told that my contract does not end automatically and that it will continue on indefinitely on a month to month basis until I cancel it by following the below procedures.

 If I qualify based on one of the three reasons listed below, I am aware that I must do the following 3 things in order to cancel my membership:

 1.   Sign a cancellation form at the gym or send a certified letter requesting cancellation

 2.   Pay a thirty-day notice at the time of request. We will not draft it unless your request between the 12-15th NO EXCEPTIONS. Our 30day notice means you must make a full payment should the next draft fall within 30 days of the request even if the request is made close after the 15th. We do not pro rate the last payment.

 3.   Pay the club improvement fee should it fall within 30 days of cancellation even if the request is made during the months of January or July- No exceptions

 

 WAYS TO QUALIFY FOR CANCELLATION

 

By Fulfilling the Contractual Obligation – You may cancel a membership once the entire contractual obligation has been met by requesting a cancellation in writing sent only by certified mail or by completing a cancellation request form at the gym. Please note, due to needing an original signature our company does not accept faxes or emails. The EFT contracts are for 12, 24 or 36 full payments and not for a specific time period. Pro rates are not full payments and are not counted as so. Per the contract the account must be current in order to submit a cancellation request. Also, our billing service requires a thirty day notice and that the last payment be paid at the time of the request. The 30 days is not prorated but means you must make a full payment if one falls within 30 days of when the request was made or received. The last payment will not be drafted unless the request is made andor received between the 12th- 15th of the month.

 

By Moving- You may cancel a membership if you move a distance greater than 30 miles from the gym by requesting a cancellation in writing sent only by certified mail or by completing a cancellation request form at the gym. Please note, due to needing an original signature our company does not accept faxes. Proof of move must accompany the request by providing one of the following forms of accepted documentation: utility bill (H2O, Land Phone, Gas, Electric, Cable), military orders with a reporting date < 30 days away, paycheck with new address, new gym membership from new location (minimum 1yr commitment), receipt for payment of university tuition 50+ miles away, notarized copy of mortgage or rental lease from an authorized leasing company (no individuals).  Please make yourself aware that the members name and new address must be on the provided documentation. The following will not be accepted: Cell phone, bank account, or credit card statement, post office address change form, drivers license, acceptance letter, school schedule, or anything other than the above will not be accepted.  (Why? Having a driver’s license or bank account in Florida does not necessarily mean you reside in Florida.) Per the contract the account must be current in order to submit a cancellation request. Also, our billing service requires a thirty day notice and that the last payment be paid at the time of the request. The last payment will not be drafted unless the request is made andor received between the 12th- 15th of the month.

 

By Death or Disability- You may cancel a membership if you develop a full disability, which prohibits you from utilizing all portions of the gym by having your physician fill out a Disability Form provided by Gold’s Gym of Mooresville. This form must be faxed directly from the doctor’s office in order to be accepted. A doctor’s note will not be accepted. In the event of a death, a certificate must be provided. Per the contract the account must be current in order to submit a cancellation request. Also, our billing service requires a thirty day notice and that the last payment be paid at the time of the request. The last payment will not be drafted unless the request is made andor received between the 12th- 15th of the month.

 

Freeze Option- In the event of an unforeseen complication or emergency, we will allow a member to freeze an account up to 6 months per calendar year for a fee of $8 monthly. Please be aware that an account must be current in order to be placed on a freeze and an account may not be frozen when a request for cancellation is submitted. In other words a full final payment must be made at the time of the request. Freeze requests must be made prior to the tenth of the month to take effect during the current month; otherwise the freeze cannot go into effect until the following 15th of the month.

 

Do not sign unless you have fully read this form and agree to all of it terms!

 

Cancellation will be denied should the last 30-day payment be returned.  If the payment is denied or returned for any reason I am aware that I must resubmit a new cancellation request by starting over. I am also aware that I will be subject to any and all fees associated with the denial (NSF or Chargeback fees) and that I will be subject to another 30 day notice payment.

 

I am aware that I am solely responsible for understanding the process for canceling my membership as stated above. I understand that I cannot contact an employee by phone to request a cancellation or for information regarding cancellation. I will take full responsibility for my cancellation and will not blame an employee for not following the above protocol.

 

I promise to follow the three policies numbered above when it comes time for me to cancel. I also promise that I will accept full responsibility for knowing the procedures and will not blame an employee should I fail to follow them since this form clearly explains the process.
